Alabama’s turbulent medical cannabis licensing programme has taken another turn this week as Montgomery County Circuit Judge James Anderson ordered five members of the regulator to testify in court.
Earlier this month, Business of Cannabis reported that Judge Anderson had issued a temporary restraining order preventing the Alabama Medical Cannabis Commission (AMCC) from issuing any further ‘integrated’ licences.
This followed news in December that the AMCC had succeeded in awarding licences to five vertically integrated medical cannabis facilities, following two earlier failed attempts to award the licences last year.
Now, according to the Alabama Reflector, five members of the AMCC, alongside its director John McMillan have been ordered to provide testimony on the process to date to establish whether the commission has followed the law in awarding licences.
Plaintiffs will also be allowed to submit written questions, and ask for documents prior to the hearing, which is currently set for February 28.
While the judge has not provided a limit on what questions can be asked, the AMCC can dispute questions during the hearing, but plaintiffs have already argued that without knowing more details about how the commission voted on licences, they wouldn’t be able to properly present their case.
